In addition to the posted resources below, any contractors providing SUD Services in Kings County must adhere to the terms and provisions as stated in the SUD State Agreement between DHCS and Kings County Behavioral Health.

NO UNLAWFUL USE OR UNLAWFUL USE MESSAGES REGARDING DRUGS
Contracted providers agree that information produced through these funds, and which pertains to drugs and alcohol - related programs, shall contain a clearly written statement that there shall be no unlawful use of drugs or alcohol associated with the program. Additionally, no aspect of a drug or alcohol related program shall include any message on the responsible use, if the use is unlawful, of drugs or alcohol pursuant to HSC Section 11999-11999.3.

If Contractor uses electronic medical records, the Contractor agrees to use a system that is consistent with federal and state requirements and those outlined in the following regulations: Access to SUD Electronic Health Record system (s) may only be granted by designated staff. Contractor must submit staff updates, including changes in roles or new or separated staff, to the SUD Administrator within 24 hours.

- In accordance with W&I Code 14124.1 each provider, shall keep and maintain records of each such service rendered, the beneficiary or person to whom rendered, the date the service was rendered, and such additional information as the department may by regulation require. Records herein required to be kept and maintained shall be retained by the provider for a period of three years from the date from the date of the last face-to-face contact with the client.

ACCESSIBILITY OF SERVICE REQUIREMENTS FOR PERSONS WITH DISABILITIES (PWD)

- Americans with Disability Act (ADA);
- Section 504 of the Rehabilitation Act of 1973;
- 45 Code of Federal Regulations (CFR), Part 84, Non-discrimination on the Basis of Handicap in Programs or Activities Receiving Federal Financial Assistance;
- Title 24, California Code of Regulations (CCR), Part 2, Activities Receiving Federal Financial Assistance and;
- Unruh Civil Rights Act California Civil Code (CCC) Sections 51 through 51.3 and all applicable laws related to services and access to services for persons with disabilities (PWD)
GRIEVANCE POLICIES
Contracted providers are expected to provide the best possible services to Kings County residents and must maintain a grievance procedure and policy.

- The policy must outline a process to encourage clients to express concerns or dissatisfaction with services.
- This policy and procedures must be distributed to each individual upon admission into the program. The Contracted provider should resolve issues quickly and informally whenever possible and should be tracked internally and reviewed by the Contracted Provider’s Quality Assurance committee/team.
- The grievance procedure and/or policy does not supersede Title 22, Section 51341, Fair Hearing process. Clients shall be informed of their right to a fair hearing related to denial, involuntary discharge, or reduction in Drug Medi-Cal substance abuse services as it relates to their eligibility or benefits, pursuant to Title 22, Section 50951.
- Clients' rights and confidentiality shall be protected at all stages of the informal complaint or formal grievance process.
- Clients will also be informed of their right to contact the “Patient’s Rights Advocate" for assistance in resolving a complaint or grievance/appeal at the county level.
LIMITATION ON USE OF FUNDS FOR PROMOTION OF LEGALIZATION OF CONTROLLED SUBSTANCES
Contractor is advised that none of the funds made available through a contract with Kings County may be used for any activity that promotes the legalization of any drug or other substance included in Schedule I of Section 202 of the Controlled Substances Act (21 USC 812).

COUNSELOR CERTIFICATION
Any counselor or registrant providing intake, assessment of need for services, treatment or recovery planning, individual or group counseling to participants, patients, or residents in a DHCS licensed or certified program is required to be registered or certified as defined in Title 9, CCR, Division 4, Chapter 8. Certification must be acquired from an accredited organization. Please CLICK HERE for a list of currently accredited certifying organizations.
Contracted Providers must have 30% of their staff Certified for each site that services are being provided.

Kings County, under the Code of Federal Regulations (CFR) and Executive Order 12549, is generally prohibited from contracting with or making sub grant/subcontract awards to any parties that are debarred or suspended or whose principals are suspended or debarred or otherwise excluded from or ineligible for participation in Federal assistance programs. In order to prohibit the procurement of any goods or services, exceeding $25,000 and ultimately funded by Federal awards, from debarred, suspended or otherwise excluded parties, each bidder must be screened at the time of bid response to ensure bidder, its principal and their named subcontractors are not debarred, suspended or otherwise excluded by the United States Government in compliance in accordance with the OMB guidelines at 2 CFR 180 that implement Executive Orders 12549 (3 CFR part 1986 Comp. p. 189) and 12689 (3 CFR part 1989., p. 235) and as set forth in 42 CFR Part 1001.
Kings County Behavioral Health, before entering into contract, will verify contractor, its principal and their named subcontractors are not on the Federal debarred, suspended or otherwise excluded list of vendors located HERE.
